OPINION

STOVER, Justice.

To address certain concerns raised in a motion for rehearing submitted by the State, we withdraw our opinion of November 5, 1997, and substitute the following in its place.

The jury found Aaron Lee George guilty in a two-count indictment for murder and for injury to a child. Appellant was found guilty on both counts. Punishment was assessed at sixty years confinement for the offense of murder and forty years for the offense...
