On March 16, 1995 the defendant-appellant Kenneth Evans was indicted for second degree murder, a violation of La.R.S. 14:30.1. On March 23, 1995 he entered a plea of not guilty. On August 1, 1995 the trial court denied the defendant's motion to suppress his confession. A trial commenced on October 25, 1995, but a mistrial was declared the next day. On November 14, 1995 the trial court held a lunacy hearing at which the court found the defendant competent...
