Johnny Faires petitions this Court for a Writ of Certiorari to quash the opinion of the appellate division of the circuit court affirming his conviction and sentence for driving under the influence.

Faires was charged by uniform traffic citation with driving under the influence. At the time of his arrest he refused to sign the citation and refused the breathalyzer test. Prior to trial, Faires filed a motion in limine seeking to exclude any...
