OPINION ON STATE AND STATE PROSECUTING ATTORNEY'S PETITIONS FOR DISCRETIONARY REVIEW

PER CURIAM.

Appellant was convicted of capital murder and his punishment was assessed at confinement for life. The Court of Appeals held the trial court erred in excluding expert testimony regarding photo bias and eyewitness identification, and reversed and remanded the case for a new trial. Weatherred v. State, 963 S.W.2d 115
