In this consolidated criminal matter, the defendants were stopped, in separate, unrelated occurrences, for violation of La.R.S. 32:295.1 which regulates the wearing of seat belts in vehicles. In each of the cases, the defendant argued that La.R.S. 32:295.1 is not a primary offense, i.e., one for which they could initially be stopped, and, therefore, that the stops were unlawful.
