The defendant-appellant, Edward A. Brittingham ("Brittingham"), was found guilty of Burglary in the Second Degree by a New Castle County jury on September 18, 1991. He was declared to be an habitual criminal and sentenced to fifteen years of incarceration. Brittingham's conviction and sentence were affirmed on appeal by this Court. Brittingham v.
