ALEXANDER, Justice.

[¶ 1] Forrest Associates appeals from the summary judgment entered in the Superior Court (Cumberland County, Mills, J.), holding that 25 U.S.C. § 811 rendered null and void an alleged agreement with the Passamaquoddy Tribe to develop and manage a proposed gaming facility. Because we conclude that section 81 did not apply to the agreement that is asserted here, we vacate the judgment.
