OPINION AND ORDER

CASELLAS, District Judge.

Pending before the Court is claimant Carlos Maldonado's Motion to Dismiss pursuant to Fed.R.Civ.P. 12(b)(6) (Docket # 5), filed on July 16, 1997. The Government opposed claimant's Motion to Dismiss on July 29, 1997 (Docket # 7). On August 7, 1997 claimant filed a motion requesting leave to reply to the Government's opposition (Docket # 9) which is hereby GRANTED.
