Appellant Loyd Stalsbroten was convicted of driving while under the influence. The Superior Court acting as an appellate court in a RALJ appeal, affirmed the district court jury verdict on several grounds. We granted discretionary review solely on the issue of whether it was proper to admit Stalsbroten's refusal to take field sobriety tests (FSTs) at trial. Thus, the issue squarely before us is whether the refusal to perform a voluntary FST is inadmissible...
