WHICHARD, Justice.

On 31 October 1994 defendant was indicted for first-degree murder. He was tried capitally in February 1995. The jury found defendant guilty and recommended that he be sentenced to death. The trial court imposed the death sentence. This Court found no error in the guilt-innocence phase of defendant's trial but vacated defendant's death sentence and remanded for a new capital sentencing proceeding. State v. Flippen, 344 N.C. 689,
