In February 1996, plaintiff Safeway, Inc. (Safeway) initiated this action for declaratory and injunctive relief against defendant Oregon Public Employees Union (OPEU),1 seeking to enjoin OPEU and all persons in active concert and participation with OPEU from entering any property or premises owned or leased by Safeway to gather signatures on initiative petitions.
