Defendant Consolidated Rail Corporation ("Conrail") has brought a motion for summary judgment against plaintiff Halton Butler ("Butler"). At issue is whether Butler suffered racial discrimination in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e, as amended, and § 1981, 42 U.S.C. § 1981, when Conrail terminated his employment in March of 1996....
