Order modified on the law and as modified affirmed without costs in accordance with the following Memorandum: Plaintiff commenced this action to recover damages for injuries he allegedly sustained at an elementary school in Buffalo. He was about to replace the cap on top of a boiler when he slipped and fell from an I-beam onto the top of the boiler. The boiler had been "down" for approximately three to four weeks for brick repairs that were performed by bricklayers retained...
