Supreme Court of Michigan.

December 9, 1998.

Attorney(s) appearing for the Case

Frank J. Kelley, Attorney General, Thomas L. Casey, Solicitor General, David G. Gorcyca, Prosecuting Attorney, and John S. Pallas, Assistant Prosecuting Attorney, Pontiac, MI, for the people.

OPINION

PER CURIAM.

This is a drug prosecution in which the key witness does not want to testify at trial. The prosecutor would like to use her preliminary examination testimony, but the circuit court and the Court of Appeals have ruled that it cannot be admitted. We reverse the judgment of the Court of Appeals and the order of the circuit court, and remand the case to the circuit court for further proceedings.
