Alan Kaniss was convicted of conspiring to distribute over 1,000 kilograms of marijuana, in violation of 21 U.S.C. §§ 841(a)(1), 846 (1994). He was sentenced to four and one half years in prison to be followed by five years of supervised release. During the period of his supervised release, Kaniss violated a condition of his supervision by using marijuana. The District Court1 then revoked the supervised release...
