SHAPIRO, District Judge.

Ruth K. Casey, Trustee, ("plaintiff" or "Trustee") brought an action to deny Chapter 7 debtor Daniel G. Kasal ("Mr. Kasal") a discharge based on "false oaths or accounts" on his bankruptcy schedules. The bankruptcy court allowed the plaintiff and Mrs. Kasal to proceed in an action against Mr. Kasal. See In re Kasal, 213 B.R. 922
