I. Background

Plaintiff, Vivid Technologies, Inc. (Vivid), seeks a declaratory judgment that it does not infringe Patent No. 5,253,283 (the "* * * 283 patent"), held by American Science & Engineering, Inc. (AS&E), or, in the alternative, that the 283 patent is invalid. This court has jurisdiction under 28 U.S.C. § 1338.
