OPINION

WILSON, Justice.

Appellant, Mashcon Wholesale Distributors, Inc. (Mashcon), appeals a judgment notwithstanding the verdict rendered in favor of appellee, A. Benjamini & Co., Inc. (Benjamini & Co.). We reverse and remand.
