SHAVERS v. STATE

No. 98-2112.

723 So.2d 371 (1998)

Virdie SHAVERS Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Fourth District.

December 30, 1998.

Attorney(s) appearing for the Case

Virdie Shavers, Bushnell, pro se.

Robert A. Butterworth, Attorney General, Tallahassee, and Melynda L. Melear, Assistant Attorney General, West Palm Beach, for appellee.

PER CURIAM.

Virdie Shavers' petition for writ of habeas corpus was denied on the finding that the Seventeenth Judicial Circuit lacked jurisdiction to consider a petition from a prisoner incarcerated outside Broward County. That conclusion was wrong because the petition challenged the conduct of Shavers' Broward County trial. The circuit court in the county of incarceration does not have jurisdiction to review the propriety of a conviction from another circuit.
