In this workers' compensation case, Plaintiff, John Nation ("Nation"), was injured in August 1995 during the course and scope of his employment with D & J Tire Company, Inc. ("D & J"). He later filed a claim contending that certain diagnostic studies recommended by his neurosurgeon had not been timely approved by D & J.
