In a thirteen-count complaint, plaintiff Frank Violissi challenges the City of Middletown's failure to promote him to police lieutenant due to alleged irregularities in the examination process. Plaintiff invokes this Court's jurisdiction pursuant to 28 U.S.C. § 1331, based upon his claim under 42 U.S.C. § 1983.
