The Plaintiff, Amgen, Inc. ("Amgen"), brings this action against the Defendants, Hoechst Marion Roussel, Inc. ("Hoechst") and Transkaryotic Therapies, Inc. ("Transkaryotic") (collectively "the Defendants"), alleging patent infringement. Amgen holds several patents covering a recombinant (genetically engineered) form of erythropoietin ("EPO"), a hormone that stimulates the body's production of red blood cells...
