SEERDEN, Chief Justice.

Todd Hixson, appellant, pleaded nolo contendere to the felony offense of driving while intoxicated. The 28th District Court found Hixson guilty, and in conformance with his plea agreement, assessed punishment at a $500 fine and five years imprisonment probated for five years.
