In 1991, Phyllis Romaguera and two other employees of the Jefferson Parish Clerk's Office ("plaintiffs") brought suit under 42 U.S.C. § 1983 against the Governor of Louisiana and Jon Gegenheimer ("Gegenheimer"), in his official capacity as the Jefferson Parish Clerk of Court.
