I. BACKGROUND

This action arises out of plaintiff Paul Amato's arrest and booking at the Saratoga Springs Police Department ("the Department") on May 26, 1994. Plaintiff alleged that while he was being booked, defendants Robert Flanagan and Lynn Thomas1 used excessive force on him.

After a four day jury trial, the jury found defendant Flanagan liable to Plaintiff...
