I. BACKGROUND

On June 19, 1997, the defendant, Robert Ainis, entered a WaWa convenience store located at the intersection of Route 73 and Taunton Road in Berlin Township. Mr. Ainis approached the register clerk on duty while holding a hypodermic needle in his hand and motioning it toward the clerk.
