OPINION

STONE, Justice.

This appeal arises from a grant of summary judgment against appellants (collectively hereinafter Gilmore) in a suit brought by Gilmore against Ralph Lopez and the Texas Attorney General. The underlying suit stems from the supreme court's determination that county Commissioners' Courts are not authorized to impose, and county Sheriffs do not have the authority to collect, pre-conviction bail bond approval fees.
