Emil Mosquera Rodriguez appeals his conviction by a jury of delivery of at least 400 grams of cocaine. TEX. HEALTH & SAFETY CODE ANN. § 481.112(f) (Vernon 1992 & Supp.1998). The trial court assessed his punishment at 40 years imprisonment and a $5,000.00 fine.
