The Defendants appeal a jury verdict awarding tort damages to an independent contractor working for them.

The facts in this case are not in dispute. James Corporation (James) is primarily a supplier of asphalt for highway projects. Prairie Construction Co., Inc., (Prairie) is a highway contractor.
