The appellant, Allen Wayne Phillips, was convicted of capital murder for the killing of Jeffery Ramsey, a child under the age of 14 years. See § 13A-5-40(a)(15), Ala.Code 1975. By a vote of ten to two, the jury recommended a sentence of death. The trial court accepted the jury's recommendation and sentenced the appellant to death.
