Following a melee that occurred on August 24, 1995 in an apartment located in the City of Elmira, Chemung County, in which defendant allegedly struck Anthony Lewis and Jeffrey Mahood in the head with a baseball bat, defendant was indicted for the crimes of burglary in the first degree and two counts of assault in the second degree.
