This matter is before the Court on Plaintiff's Complaint requesting injunctive relief pursuant to the Alien Tort Claims Act, 28 U.S.C. § 1350 (the "ATCA"),1 Defendant's Motion to Dismiss pursuant to Federal Rules of Civil Procedure ("FRCP") 12(b)(1) and (6),2 and Plaintiff's Motion for Judgment of Default pursuant to Rule 55 of the FRCP.
