OPINION

DUNCAN, Justice.

Pursuant to a detainer based upon an aggravated robbery charge, the State indicted Eric Espinoza on two attempted capital murder charges arising out of the same transaction. Thereafter, Espinoza was convicted on one of the attempted capital murder charges, and the jury assessed punishment at thirty-five years confinement in the Institutional Division of the Texas Department of Criminal Justice.
