Appellant "Jeff" Mitchell, his brother Stephen Mitchell, and Kyle Spell were charged with the malice and felony murder of Danny Hucks and with possession of a firearm during the commission of a crime. The Mitchell brothers were tried jointly. The jury found Stephen guilty of voluntary manslaughter, felony murder, and possession of a firearm, and the court sentenced him for the latter two offenses after merging voluntary manslaughter with felony murder...
