The plaintiffs, Robert and Elaine McCann, have, for years, used a driveway located on the property of the defendant, Herman Normand, in order to reach their home. The plaintiffs filed suit against the defendant seeking a judgment recognizing a right of passage or servitude of passage on that driveway.
