The appellant was indicted for three counts of capital murder in the murder of J.W. Griffin: murder committed during a burglary in the first degree, murder committed for pecuniary consideration, and murder committed pursuant to a contract for hire. The appellant was also indicted for one count of theft of property. The count charging murder made capital because it was committed pursuant to a contract for hire was subsequently dismissed.
