Arising from an on going problem between neighbors is this appeal from the grant of appellees' motion for summary judgment on the ground that appellants' complaint should have been pled as a compulsory counterclaim to a case that had been previously adjudicated adversely to appellants, Laura Day Calk v. Walter Aycock and Joan Aycock, Case No. 94-6451-4, DeKalb Superior Court. Appellee Thomas Calk was not a party to that previous action.
