In this workers' compensation case, the plaintiff, Keith Fontenot, was injured during a scuffle with an employee of a third party, while delivering produce to the Bronx, New York. Fontenot filed a disputed claim for compensation after the defendant, James Karl Richard d/b/a J.K. Richard Trucking (Richard Trucking), refused to reimburse his medical expenses or pay him indemnity benefits, claiming that Fontenot was the initial
