SHERCK, Judge.

This is an appeal from a directed verdict rendered by the Erie County Court of Common Pleas after opening statements were given in a negligence trial. Because we conclude that the trial court improperly found that plaintiff failed to set forth facts which might entitle him to a judgment in his favor, we reverse.
