Ordered that the order is modified, on the law, by deleting the provision thereof which directed the plaintiff to pay the defendant the sum of $10,740, and substituting therefor a provision directing the plaintiff to pay to the defendant the sum of $700; as so modified, the order is affirmed, with costs to the plaintiff.
