For incidents occurring on October 21, 1996, James T. Smith ("Smith") was charged with bank robbery by intimidation, 18 U.S.C. § 2113(a). At trial, Smith admitted to the facts of the bank robbery, but defended himself with the theory that his actions during the robbery did not constitute intimidation as required under the statute.
