The appellant, Vernon Madison, was convicted of two counts of capital murder in the death of Julius Schulte, see § 13A-5-40(a)(5), Code of Alabama 1975. The first count charged the appellant with killing a police officer who was on duty, and the second charged him with killing a police officer who was performing an official or job-related act.
