In this appeal the defendant challenges the constitutionality of section 316.1935(2), Florida Statutes, which provides an enhanced penalty for the offense of fleeing and eluding a law enforcement officer. By the terms of the statute, fleeing and eluding an officer is a third-degree felony if the offender causes the officer to engage in a "high-speed vehicle pursuit."
