This case is before this Court upon an appeal from the final order of the Circuit Court of Wood County, West Virginia, entered on March 1, 1996. In 1995, the appellant, Carl E. Lockhart, was found guilty by a jury in that court of the offenses of sexual assault in the first degree, battery, burglary and assault during the commission of a felony.
