The defendant was the operator of an automobile involved in a head-on collision on Route 20 in Marlborough on July 2, 1994, at 4:30 p.m. The passenger in the defendant's car was critically injured in the accident. An elderly couple in the second vehicle also suffered serious injuries.

On November 16, 1994, a Middlesex County grand jury returned an indictment against the defendant charging him with operating a motor vehicle recklessly or negligently...
