Henry Sterling, was convicted in Randolph District Court of disorderly conduct, a violation of § 13A-11-7(a)(2), Code of Alabama 1975. He appealed his conviction to the circuit court for a trial de novo. He then filed a motion to dismiss claiming that § 13A-11-7(a)(2) was unconstitutionally vague and overbroad; the trial court denied the motion. After a jury trial, he was found guilty.
