Ordered that the order is modified, by deleting the provision thereof granting that branch of the defendant's motion which was to dismiss so much of the complaint as may be read to state a cause of action for support, maintenance, and equitable distribution, and substituting therefor a provision denying that branch of the motion and reinstating so much of the complaint as may be so read; as so modified, the order is affirmed insofar as appealed from, without costs or disbursements...
