The defendant, Scott Vanhouton, is charged in the Superior Court with operating a motor vehicle while under the influence of intoxicating liquor, fifth offense. G. L. c. 90, § 24 (1) (a) (1). He filed a motion to dismiss the indictments on the ground of double jeopardy, which was denied.
