Appellee Tinker sued the District of Columbia for injuries allegedly suffered in the course of an arrest. A jury awarded him $500,000 in damages. During the pre-trial phase of the case, the trial court denied the District of Columbia's motion for leave to amend its answer by asserting the statute of limitations as a defense, and denied the District's motion for summary judgment based on the statute of limitations.
