This action arose as the result of an automobile accident in which 18-year-old Frances Evans was killed when she lost control of her car on a wet highway and collided with a tractor-trailer truck. Josephine Evans, Frances' mother, sued the Georgia Department of Transportation ("DOT"), claiming that it negligently failed to repair and maintain the highway where the accident occurred.
